GENERAL TERMS AND CONDITIONS (hereinafter as GTC)

GTC in general

In the Travel organization company Lovag (hereinafter as the Agent) acts and intermediates as an Agent between a Traveller and a Travel organizer/ Outfitter.

Agency is authorized to conclude contracts with Travelers on behalf and for the account of the Travel organizer/ Outfitter what means that there is legal connection between the Traveller and Travel organizer/ Outfitter in respects to their service quality. By closing the Travel contract with the Agent the Traveller accepts GTC of the Agent and Travel organizer/ Outfitter. It is the agent’s duty to inform the Traveller before closure of Travel contract about GTC which will be valid for and applied to the contracted Travel.

In case Agent contracts services necessary for successful travel organisation with some other service providers, GTC which those service providers consider as valid will be applied. It is Travelers duty to inform themselves about other service providers GTC details.

Closing a Travel contract

The offers which the Agent puts forward by Internet, leaflets, price lists or which by some other means of communication have been given to Traveller notice are binding in case they contain special validity clause.

It is Traveller's obligation to clarify conditions and details of the Agent's offer before accepting it. Traveller is not allowed to renegotiate terms and conditions of the offer after its acceptance.

The Travel contract between Traveller and the Agent will be considered as closed when:

• The Traveller accepts Agent’s valid offer in writing or by some other means of communication
• The Agency confirms the Traveller’s offer acceptance in writing
• The Traveller pays advance payment amounts requested by the offer and adequately issued pro forma invoices

By closing the Travel contract the Traveller empowers the Agent to contract all services (passenger transport, accommodation, insurance etc.) required for successful travel organisation, provided they have been stipulated in Agents offer. If necessary and by special Travelers order Agent intermediates to or carries out legal businesses prescribed in destination, departure and transit country in order to assure immigration and transit of Travelers, export/import of weapon and ammunition and export/import and transport of hunting trophies. The Agent is entitled to reimburse from Travelers all costs arisen by carrying out above mentioned services.

After closing the Travel contract the Traveller is without Agent’s authorization not allowed to negotiate with the Travel organizer or Outfitter’s services being subject of the Travel contract. It is Traveller’s obligation to compensate to the Agent any current or future damage caused to his business by disrespect of this provision.

 

Payment

By closing the Travel contract the Traveller becomes liable to pay all payable amounts in accordance with Agent’s accepted offer and adequately issued statement of account, pro forma and final invoices.

Agent draws up the final invoice for amounts Traveller is liable to pay based on:

• Consumed services according to travel Protocol
• Expenses of all other unspecified services Travelers consumed during this particular travel

Traveller is obliged to meet the deadlines and payment instructions stipulated in the Agents offer and invoices. In some occasions and upon special Agents authorisation invoices can be paid directly to the Travel organizer/ Outfitter in the country of destination or some other service provider.

All amounts which should after travel termination be paid to the Traveller by the Agent have to be paid in the shortest possible time after date when Agent’s liability was established and due. Agent guarantees to the Travelers refund of advance payed amounts through compulsory insurance contract in accordance with the Croatian Tourism service providing Act (above €5,000). On Traveller’s request parties may agree Agent to guarantee advance payment return by a special bank instrument.

 

Travel cancellation and/or interruption

In the case when Traveller cancels the contracted Travel but the terms and conditions of the cancellation are not specified in the offer the following provisions will be valid:

If Travelers desist from confirmed journey they may nominate another person to replace them. A new contract is then closed under the same terms.

Travellers have right to postpone the travel up to 30 days before commencement, for a period of max. 12 months, under the following conditions:

- Agent reconfirms travel under existing contract provisions
- New travel contract is concluded

Amounts already paid will be recognized except costs already paid to service providers which cannot be refunded.

In case of cancellation Traveller must cancel latest 90 days before travel starts. Traveller is obliged to reimburse the Agent all expenses procured until cancellation date. If expenses are lower than the amount paid, the Agent must refund the balance.

If cancellation occurs after the defined period or Traveller interrupts the travel, Traveller loses right to refund and must reimburse all costs caused by cancellation or interruption.

This especially refers to:

• Expenses and losses caused to the Travel organizer/ Outfitter
• Expenses already paid by the Agent to third parties (visas, permits, bookings, guides etc.)

The Agent must submit to Traveller a cost statement supported by third-party documents.

 

Changing the price and contract conditions

The Agent holds the right to change prices and other conditions when reasons beyond his influence affect expenses or other circumstances (price changes, transport fees, exchange rates, government regulations etc.).

Travellers must be notified immediately and may cancel the travel if they do not accept changes. The Agent must then refund all amounts paid.

Guarantee

Unless stipulated in the offer the Agent does not guarantee service quality of the Travel organizer, Outfitter or other service providers. Agent guarantees specifics of hunting area, hunting manner, success rate and trophy quality only to the extent stipulated in the offer.

Agent is not responsible for accidents, lost luggage, delays or force majeure events.

The Agent guarantees damages only if caused by serious oversights or negligence of his staff. Compensation covers transportation return, accommodation and food, excluding hunting expenses and additional services.

 

Complaints and claim

Travellers may file written complaints within 15 days after Protocol date. Only complaints supported by written documents or remarks in the Protocol will be considered.

Traveller must immediately notify irregularities; otherwise loses right to claim.

Agent must reply to a complaint within 15 days. Filing a claim does not remove Traveller’s obligation to pay for consumed services.

 

Records on journey – Protocol and Statement of account

After journey completion the Agent prepares a Protocol and Statement of account stating all used services. Documents must be signed by Traveller and Agent. If Traveller refuses to sign, documents become valid if signed by all service providers.

 

Cancellation of Travel contract and changing itinerary by the Agent

Agent may cancel the contract if Traveller breaches its provisions. Traveller must reimburse all caused costs.

Agent may cancel due to unforeseen circumstances endangering Traveller or making travel impossible.

Agent may also change itinerary due to unforeseen circumstances and must notify Traveller. If no new contract is agreed, travel is considered cancelled.

Trophies

Traveller becomes owner of trophy and must respect regulations regarding evaluation, preparation, transport and export/import.

Agent may provide information but does not guarantee realization unless stipulated in contract.

 

Hunting related law and rules

Travellers must inform themselves about hunting laws and respect all regulations. Violation may lead to travel interruption and full cost reimbursement.

Weapons and ammunition

Travellers must inform themselves about regulations related to traveling with weapons and procure necessary documents. Agent may help but does not guarantee positive outcome.

Miscellaneous

Only GTC communicated at contract closing are valid. Disputes should be solved amicably; otherwise through a competent court.
