LOVAG

Naš angažman u sufinanciranju lovoovlaštenika i učestaloj prisutnosti u njihovim lovištima omogućava nam da svojim klijentima ponudimo onu vrstu i kvalitetu lova kakvu realno mogu očekivati.

Ivan Grosinic

Stojimo vam na raspolaganju.

General Terms and Conditions

Subject of the Contract

In the organisation of travel, the travel agency LOVAG (hereinafter: the Agency) acts as an agent and intermediary between the client and the travel organiser (hunting grounds / hotels, etc.) operating in the destination country. The Agency is contractually authorised to conclude travel contracts with travellers in the name and on behalf of the hunting travel organiser, meaning that, with regard to service quality, a legal relationship exists between the travel organiser and the client.

By concluding this contract, the traveller accepts the General Terms and Conditions of the travel organiser, which, together with the organiser’s name, are stated in the Agency’s offer. By concluding this contract, the client authorises the Agency to mediate in and/or conclude contracts with other service providers necessary for the successful organisation of travel (airlines, transport companies, hotels, vehicle rental companies, insurance companies, etc.), as well as to organise and mediate services required in the destination, departure and transit countries relating to immigration (visa regime), export/import and transit of weapons and ammunition, and processing of export/import and transport of hunting trophies. The Agency is entitled to reimbursement of costs incurred in performing the above-mentioned services.

Conclusion of Contract

Offers presented by the Agency via the internet, brochures, price lists or other means of communication are binding. It is the client’s duty to clarify any unclear details of the offer before confirmation.

The contract between the client and the Agency shall be considered concluded:

a) If the client accepts a specific Agency offer in writing or by any other traceable means of communication

b) If the Agency confirms the client’s verbal booking in writing

c) If the client pays part or the full amount specified in the offer

By concluding this contract, the client undertakes not to negotiate directly with the travel organiser regarding the provision of services without the Agent’s authorisation.

Payment

By concluding the travel contract, the client assumes the obligation to pay all amounts due prior to the commencement of travel in accordance with the offer. The client must comply with payment deadlines and methods stated in the offer, any special agreement at the time of contracting, and the final statement of account.

After completion of the travel, the Agency prepares a final statement of account based on the protocol drawn up by the travel organiser in the destination country, including all costs paid by the Agency on behalf of the client and all services consumed. Amounts paid in advance are credited. Any outstanding balance must be paid within the deadline stated in the statement of account.

Refund of advance payments is guaranteed through an insurance contract in accordance with the Croatian Act on the Provision of Tourism Services. This applies only to advance payments exceeding €5,000. Upon request, advance payments may be guaranteed by a special bank instrument.

Travel Cancellation

If cancellation terms are not specified in the offer, the following applies:

If the client cancels a confirmed trip, they may nominate a replacement person. The Agency will conclude a new contract with that person under the same conditions.

If the deposit serves as a guarantee of participation, cancellation up to ninety (90) days before departure entitles the client to a 50% refund of the deposit. Cancellation within 90 days before departure results in loss of the deposit. If the deposit does not cover cancellation costs, the client must reimburse the difference.

This particularly includes:

a) Cancellation costs according to the organiser’s terms

b) Agency mediation and processing fees

c) Costs of visas, permits and licences

d) Costs related to third-party service providers

e) Flight, vehicle rental, hotel and guide cancellation costs

Price and Offer Changes

The Agency reserves the right to change prices in the event of increased transport costs, government taxes, airport or port fees, exchange rate fluctuations or other circumstances beyond its control (e.g., hunting bans, disease outbreaks, increased taxes). The client will be promptly informed.

Guarantee

The Agency does not guarantee the quality of services provided by the travel organiser or third-party service providers unless explicitly stated in the offer. Unless expressly guaranteed, the Agency does not guarantee hunting success, trophy weight, size or quality.

The Agency is not responsible for accidents, baggage loss, delays or force majeure events (political unrest, infectious diseases, natural disasters, etc.).

The Agency is liable only for damages caused by gross negligence, misconduct or intentional wrongdoing by the Agency or its authorised persons. Compensation in such cases is limited to three times the travel price, excluding licence fees, permits and trophy fees.

Complaints

Complaints must be submitted in writing within 30 days after the scheduled end of the trip. The client must immediately report irregularities during travel to allow correction on site. If this is not possible, a written protocol signed by the organiser or an independent witness must be prepared and submitted to the Agency.

Claims for unused services due to personal reasons (late arrival, early departure, etc.) will not be accepted.

Hunting/Travel Protocol

After completion of travel, a Hunting/Travel Protocol is drawn up and signed by the organiser and client. This document forms the basis for the final statement of account and any complaint procedure.

Termination by the Agency

The Agency may terminate the contract if the client fails to fulfil contractual obligations. The client must reimburse all related costs.

If unforeseen circumstances make performance significantly difficult or impossible, the Agency may cancel the contract and is entitled to reimbursement of 50% of unrecoverable preparation costs.

Trophies

The client must comply with trophy evaluation systems and legal export/import regulations. The Agency does not guarantee delivery of trophies to the client’s country of residence. Upon request, the Agency may provide written information regarding evaluation systems, preparation options, prices and export/import procedures. Full organisation of trophy preparation and import requires a separate contract.

Hunting Laws and Regulations Abroad

Hunters must comply with hunting laws in the destination country. Violations may result in immediate termination of the hunt without refund. Shooting protected game or hunting during closed season obliges the hunter to pay the agreed trophy price plus statutory penalties.

All hunters must possess valid hunting licences and required insurance.

Weapons and Ammunition

The client must comply with all legal requirements concerning transport and possession of hunting weapons and ammunition. The Agency may assist with formalities but does not guarantee approval by authorities.

Loss of baggage or weapons does not constitute grounds for price reduction or cancellation. Assistance in obtaining replacement equipment may be provided at the client’s expense.

Miscellaneous

Any disputes shall be resolved amicably. Failing that, jurisdiction lies with the competent court in the country of the party seeking legal remedy.
